HOW TO ANSWER A WRONG SUMMON?
My Gradma is 80 living on a retirement home, when yesterday at 9pm someone in the retirement home let this guy in and directly to my grandmas room, even told the person that It was very very important paper work she needed to sign (life or death), then they opened the door and my grandma was asleep and the guy told her if she was "MARY LOU" (names changed), her name IS "MARY", but her last name is not "LOU" is "JANE", so this guy said she needed to sign it anyways and she did because she was told it was necessary. After the call from her next day I immediately went to the place and found out that ITS A SUMMON and that she has being served from a collection office looking for this wrong "MARY LOU" and another COMPANY, WHAT SHOULD WE DO TO KNOCK OFF THIS WRONG SUMMON???
Please help.
I would be making a lot of calls to that collection agency and placing complaints against the serving agent until I was sure the matter was resolved. Make sure to have any documentation handy to provide ID that "Mary" is not the one they are contacting. You may have to have her present in some way for their end of the legalness of it.
If you dont get the issue straightened out then, then I would take the papers and the issue to the local courthouse, so that you have some sort of legal notification to ensure that you are not responsible for any false information or forgery claim. Write down every little move you do in this process and keep it handy. If you receive any further mail or phone calls due to this, report them all and once again, keep a documentation of it.
I am not sure what office at a courthouse would handle such a thing, but Im sure you could get a directory and assistance there.
Its better to be prepared in case of any legal action in the future. Keep all the bases covered. Hopefully you won't need that.
Also, even though "Mary Lou" obviously is in trouble, she may end up with further troubles if this matter is not resolved on her end, not having the proper summons or notification to respond to the company.
