Shop Sign Payment
Non-payment for repair services is a civil matter? This can't be right...?
I own a computer repair shop and today a customer came in an bullied my secretary. Upset about his balance, he went behind the counter and grabbed his laptop and left without paying. (He's also a really big guy)
I called the police and they dispatched an officer. I gave them all his information but he said they wouldn't arrest him and that it was a civil matter! He said that if if my property was involved (like a hard drive installed) then it would definitely be theft of merchandise, but the fact that it was virus removal service makes it not criminal.
Ok, I understand all of this and I think it's bullcrap. There has to be a way around this to prevent it from happening again. One Idea would be to make them sign a contract stating that their laptop becomes our property until payment is received- but would that hold up, or would the cops just say it's a civil matter. I don't know so I'm asking you.

The contract that you propose may not be enforceable in court. That may be found to be an unfair business practice and the contract may be found against public policy. I think it is a bad idea. You should discuss this idea with your lawyer before you do it. He may have the same opinion of it that I do.
To protect yourself against unpaid fees, try implementing a deposit system. Trying to get your fees from unhappy clients can be expensive and difficult. At least in those situations, you have the deposit even if you never see the rest of the fees.
