Shop Dog Cat
An old lady goes to the shop for some cat food! she picks up 2 tins and goes to the checkout..................
there the cashier says to the old lady do you have proof that you have a cat because there are some pensioners buying pet food to eat themselves....off the lady goes and 15 mins later comes back with her cat so the cashier gladly sells her the cat food.
the next day the old lady goes back to buy some dog food picks up 2 tins and goes to the checkout to which the cashier has the same request...so off the lady goes and comes back 15 mins later with her dog to buy the tins of dog food.
the next day the old lady goes back to the shop carrying a small cardboard box with a little hole in the top. she walks in and goes straight to the checkout where the cashier is and says put your finger in the hole dear. the cashier is a little bit unsure but puts her finger in the hole anyway. she pulls it back out and says CHRIST THAT SMELLS LIKE $H!T, to which the old lady replies IT IS, NOW CAN I GO AND BUY SOME BLOODY TOILET ROLLS!

Dog injured at the groomers shop....who's liable?
My little sister owns a groomers shop she opened a month ago. After she bathed and dried a six month old large breed, he chased after the shop cat and injured his knee. My sister took the dog to the vet immediately because he was limping and the vet told her he had injured his cruciate ligament. He explained this was a common injury among young athletic dogs who playing roughly/take a bad step and injures the knee while playing. He also explained this is usually a very sudden lameness in a young large breed dog. The icing on the cake is the pup could potentially need expensive surgery and the owner blames my sister and wants my sister to pay the vet bills. My little sis is in tears...who is liable?
This is tricky because ACL ruptures don't just happen over night. The injury could be due to poor breeding and genetic predisposition. This type of injury could have occured while the pup played and ran around at home just as easily as it happened at the groom shop. The dog could have even had a partially torn ACL prior to seeing your sister.
IMPO your sister shouldn't be held liable for this injury. This injury could have happened anywhere, anytime. The fact that the dog was allowed to run around the groom shop, chase the cat, etc diesn't help the situation.
I would have the dog evaluated by a a boarded surgeon (their name would be followed by ACVS) and have the dog ingury fully evaluated. Radoigraphs should be read out by a veterinary radiologist who could better answer the question of where this had been going on for a while prior to the incident a the groom shop (acute injury vs. chronic injury). Also, have the slope of the caudal tibial plateau evaluated. If it has a steep slope (20 degrees or more) then this could have caused the injury (i,e. breed predisposition)
If your sister wanted to take this to litigation, I think she could prove this wasn't her fault. If she didn't want to, I'd have her insurance offer to pay for half of the surgery with the condition that the dog has surgery with a boarded surgeon (this lessens the chance of the leg being screwed up by an over zealous veterinaian who is not cmopatent in doing this type of surgery).
The surgery recommended for this type of injury would be a TPLO (tibial plateau leveling osteotomy). It is expensive, but this would be the best for a dog of this size and activity. The surgery involved changing the angle of the caudal tibial plateau by creating an osteotomy (fracture) and plating it in a different position. These dogs do great after surgery and as long at the owners observe proper care at home (activity restrictions, no licking at the incision, etc), the dog should do great.
So, I am in agreement that your sister should NOT be held liable for this injury. If she wanted to persue this legally, she should contact a lawyer and a board certified surgeron (you can find one at www.ACVS.org) and have radiographs evaluated by a veterinary radiologist and have the slope of the tibial plateau evaluated. It is my opinion that this accident occured out of coincidence, rather than negligence.
