What is a building owners liability once a building is rented/leased to a business?
I have been attempting to rent a storefront to open up a tattoo shop, but in the process have run into an issue where the building owners are worried about their liability if they rent to a tatto shop. And one owner stated that his insurance was going to drop his coverage if he rented to a tattoo shop!
What can I do to remedy this situation and what exactly is the building owners extent of liability after the space is rented?
I'm not a lawyer, but can offer some general advice. In terms of liability, the building owners are liable for everything related to the building itself (includings sidewalks, etc.). You would be liable for things related to your business.
In my opinion, the building owners are more concerned about the type of clientelle that tatoo shops attract and the increased potential of that clientelle to damage the building in some way (ie. B&E, graffiti, etc.). From an insurance company's point of view, they are concerned about risk. An owner renting to a tattoo parlour is much riskier than renting to a barber shop due to the different quality of clientelle. It might be discriminatory, but it comes down to money for both the owner and the insurance company.
