Can an apartment complex remove an immenity of the property during the lease?


I live in an apartment complex that was purchased by another company in December. My lease expires in July. The new company began some remodeling and removed the workout room that we had. Although it was small, with only a few equipment it was just across the parking lot which made it convienient and one of the reasons I chose the complex. The company arranged for us to get discount memberships at a nearby health club, but I'm now having to pay an additional $20 for this a month where before I didn't have to pay for a workout facility. Is this legal? Are immenities covered under leases, or does it just include the actual apartment you're living in?

Unless the immenity is specifically stated in the lease (as in Lease holder will have unincumbered access to workout facility from 10am to 10pm) they can add or remove immenity's at will (most leases state just that, they can give or take away at will).

I would also watch out, it is common when a new owner comes on the scene and starts making improvements they are planning on hiking rent when the leases come up for renewal. Start asking around or check the owner's website to see what they are charging at similar properties...so you are not caught off guard when renewal time comes.
