Speed Camera (Not Recognised) - Points OR FINE?
Hey all
Today I got flashed by a camera in a business park. I was doing 50mph in a 30 limit. All I saw was 1 speed limit 30 sign.
There was no speed camera sign and it was not yellow or in high visibility. I did not recognised the type of speed camera it was on a metal pole there were 2 'CCTV' like cameras, bunched together.
It only flashed once, and since it was in the business park on the road to the gym, I am presuming it was owned by them and will go back to the 'control box'.
My question is, do they have the power to issue penalty points, I presume they can issue a fine but it is the '3' points I don't want if the image comes out (It was at night).
Unless you were on one the car parks on the estate, then you were on a public highway, and as such, the road traffic act regs. apply. therefore, you may well get a ticket, so expect a 60 quid fine and 3 points on your licence in the post in a couple of weeks. If the park is privately owned and not maintained by the local authorities, then the owners have the legal right to ban you from entering the estate/ park and also to issue you with a contravention notice, for which they can legally charge you an admin. fee.The amount will depend on the owners.As for the cameras being unsigned and not high vis. or prominently sited, the police/ councils now no longer have to advertise where they are, nor are they required to make them easily visible.Sorry for the bad news, but then, if you exceed speed limits by such a margin........... (not preaching, I have been done for excess speed in a 30 zone myself.(thanks mr brunstrom).
