What if you unknowingly drank alcohol out of a dr pepper bottle and you got caught and charged with a mip?
What if you unknowingly drank alcohol out of a dr pepper bottle and you got caught by the police and charged with a mip? you took the breathalizer twice and on the first on you blew 0.00s and on the second time it was a .024. could i fight this in court? and why?
A regular beer is only supposed to raise the blood alcohol content by .015 in an hour. You'd have had to consume more than one beer and then for a reading to be 0.00 it would have had to be right after you had consumed both. And both would have had to be consumed within seconds of each other.
So for the dr pepper scenario to be possible, it would have had to contain two ounces of alcohol equivalent to two beers and then drank all at once and the first breath test given immediately after it was consumed. The next test would be at least 15 minutes later.
I doubt this scenario happened as the alcohol in the dr pepper would have been quite noticeable.
