Can I sue a bar for serving me while i was visibly intoxicated?
Please only honest answers, no sarcasm and no tellin me i deserved it i know that. OKAY. so i went to a bar, got drunk, and drove, i know dumb mistake, anyhow i got a complaint called in on me from the bar saying i left there drunk, well i got pulled over and got a Dui, is there anyway i could sue the bar for servin me when i was intoxicated? im in Pa and i blew a .189 any input is appreciated, thank you!
You can sue. You won't sue successfully.
The idea behind allowing people to sue a bar that over serves a customer is to protect the innocent victim the drunk driver t-bones in an intersection. The philosophy is that the victim of the drunk driver should be able to sue the drunk driver AND the bar so the victim has a greater chance of getting money in a lawsuit and so bars have a greater incentive to keep drunks from getting behind the wheel of the vehicle.
The bar will face some scrutiny and perhaps some penalties for over serving you. Your state's equivalent of the Liquor Control Board monitors this type of information and can take enforcement action against bars that have a history of over serving.
With regard to your specific situation, though, it ultimately comes down to personal choice, personal responsibility and personal accountability. The bar's defense would be that nobody forced you to drink enough to get to twice the legal limit and they will probably claim that you didn't appear drunk. Alcohol recognition experts would testify that you are almost certainly a conditioned drinker. (That you were functional enough to walk to the parking lot and get behind the wheel at a .189 indicates you drink quite a lot.) Conditioned drinkers are harder to identify as being drunk. And every jury tends to be downright hostile to drunk drivers, so I just don't see that you have any hope of a successful lawsuit.
